Recovering Attorney's Fees For Breach of Contract

Over the course of the past two months, Brandon Houtchens tried three separate civil cases, each of which involved a dispute about whether the parties performed according to the requirements of contract.  Two were landlord/tenant disputes, where the terms of the lease were at issue.  In the other, the terms of a professional services contract were at issue.  Fortunately, each of our three clients won at trial.  However, in only one of the three cases was our client entitled to recover its attorney’s fees from the other party, and in that case, the loss for the opposing party was especially costly.  In the other two cases, our clients’ respective victories were somewhat limited by the fact that neither would be entitled to reimbursement of Brandon's fees from the party who lost.  The lesson:  Assuming you plan on fulfilling the terms of your contracts, and to allow for a full recovery in the event the other party does not, it is good practice to include an attorney’s fees provision in your contracts.
